Wine tasting and winery tours are popular activities to enjoy when visiting Portland. Thus, Portland is a city where various alcohol cultures, including beer, wine, and whiskey, coexist.
However, driving after enjoying alcohol leads to very serious legal consequences in Oregon. In Oregon, driving under the influence is referred to as 'DUII' (Driving Under the Influence of Intoxicants) rather than 'DUI.' This term encompasses not only alcohol but also driving under the influence of marijuana or other drugs, hence the use of the broad term 'intoxicants.' Although marijuana is legalized in Oregon, driving while under its influence is still punishable as DUII.
The legal blood alcohol concentration (BAC) limit for DUII in Oregon is 0.08% for general adult drivers (21 and older). A felony conviction can severely impact immigration visas or permanent residency, so foreign nationals should be particularly cautious.
If arrested for DUII, the vehicle will be towed immediately, and the officer will confiscate the driver's license. Separate DMV hearings and criminal court proceedings will follow. A DMV hearing must be requested within ten days of the arrest; failing to do so will result in automatic license suspension. Regardless of whether a lawyer is hired, the clock starts ticking immediately after a DUII arrest, so it is crucial to contact a lawyer right away if faced with such a situation.
In addition to DUII, there are other alcohol-related laws to be aware of in Oregon. Under the open container law, simply possessing an open container of alcohol in a vehicle on the road can lead to penalties. This applies even if a passenger, not the driver, is drinking. Additionally, public intoxication is legally restricted in Portland, and individuals may be subject to enforcement based on police discretion.
The safest way to get home after drinking in Portland is to use ride-sharing services like Lyft or Uber, or public transportation such as MAX light rail or buses. Portland has relatively good public transportation access for a major city, making it possible to plan transportation in advance before drinking.
