The regulations regarding marijuana and related products in the 50 states of the U.S. are categorized into four stages: 'Adult-Recreational', 'Medical', 'CBD-Only', and 'Fully Prohibited'.

As of April 2025, the situation is as follows.

Fully Prohibited — 6 states where any form is illegal (No medical program, CBD including THC products are also illegal)

Idaho, Kansas, Nebraska (Possession of small amounts is decriminalized to a certain extent, but both medical and CBD are not allowed)

8 states where only CBD (low-THC) is allowed, medical and recreational are illegal (Note: CBD oil THC limit is around 0.3 to 0.5%)

Alabama, Georgia, Indiana, Iowa

Kentucky, Tennessee, Texas, Wisconsin

15 states where only medical use is allowed, recreational is illegal but patients can legally consume

Arkansas, Florida, Hawaii, Louisiana, Mississippi, New Hampshire

North Dakota, Oklahoma, Pennsylvania, South Dakota, Utah, West Virginia

Legal for recreational use (24 states + DC)

Points to remember

- There are only 6 'illegal states'
Most states allow at least medical or CBD use. The only places that are completely prohibited are the 6 states mentioned above.

- Laws are changing rapidly
Medical bills are being introduced every year in states like Kansas, North Carolina, and Wyoming, and there is a high possibility of changes due to the 2026 general election or citizen initiatives.

- Federal law remains illegal
Regardless of state-level legalization, federal law (federal jurisdiction, borders, aircraft, etc.) is still subject to regulation, so caution is advised when traveling.
