Fort Myers is a recreational hub with many beaches, golf courses, and restaurants.

This also means there are plenty of opportunities to drink, leading to the risky choice of driving after drinking. Florida's DUI penalties are very specific and strict. Here's a summary of the numbers and legal provisions.

Under Florida law, DUI (Driving Under the Influence) refers to operating a vehicle with a Blood Alcohol Concentration (BAC) of 0.08% or higher. For minors under 21, a BAC of 0.02% or higher results in DUI penalties. Commercial drivers face stricter rules, with a BAC of 0.04% or higher qualifying as DUI.

The severity of penalties varies based on the number of offenses and BAC level. For first-time offenders, fines range from $500 to $1,000, with a maximum of 6 months in jail, a license suspension of 180 days to 1 year, and over 50 hours of community service. If the BAC is 0.15% or higher or if there is a minor in the vehicle, even first-time offenders face enhanced penalties, with fines increasing to between $1,000 and $2,000.

For a second offense, there is a mandatory license suspension of over 5 years, up to 9 months in jail, and the requirement to install an Ignition Interlock Device in the vehicle. For three or more offenses, it is classified as a felony, with a maximum of 5 years in prison and a long-term license suspension possible. If someone is killed due to DUI, the offender can be charged with DUI Manslaughter, facing up to 15 years in prison.

In the Fort Myers area, sobriety checkpoints are regularly conducted.

Friday and Saturday nights, as well as holiday weekends, are peak times for these checkpoints. After a DUI arrest, the vehicle is seized, and bail is required for release. Additional costs such as court appearances, attorney fees, increased insurance rates, and license reinstatement fees can add up significantly. Instead of driving after drinking, using Uber or Lyft or opting for a designated driver is a much wiser choice from legal, financial, and safety perspectives.
